Abstract
Cultural Human Rights (CHR) have been gaining increasing prominence on the international stage, particularly within the framework of UNESCO and other human rights instruments, although their conceptualization and implementation remain underdeveloped, especially in Portugal. The Constitution of the Portuguese Republic enshrines principles related to cultural identity, cultural freedoms, and access to culture, aligning with the paradigm of cultural democracy, which has recently been reinforced by initiatives such as the National Arts Plan and the Porto Santo Charter. However, there remains a lack of a framework of indicators that would allow for the systematic assessment of the degree to which these rights are realized. This project sought to address this gap by developing a Framework of Cultural Human Rights Indicators (QIDHC), combining normative analysis and a systematic review of the literature. Approximately fifty national and international legal instruments and a corpus of 192 scientific documents were analyzed, enabling the identification of 63 indicators and their respective definitions. Based on this evidence, a three-tiered assessment model is proposed—comprising structural, process, and outcome indicators—in line with the methodology of the United Nations High Commissioner for Human Rights, grounded in seven structural attributes derived from the Constitution and foundational legislation. The study also identifies regulatory gaps and significant limitations in data availability, highlighting the lack of a regular and sufficiently detailed survey on the cultural practices and participation of the Portuguese population, which hinders the monitoring and evaluation of public policies in this area.
