The Criminal Jury in Portugal. A History of a Forgotten Legal and Political Institution (1822-1927)

This project aims to study for the first time the history of the Portuguese criminal jury from its adoption in 1822 to its abolition in 1927. Although the jury has been the subject of some legislative investigation, to date there has been no research on its composition, organisation or judgements. In other words, virtually the entire history of the jury in Portugal has yet to be written. In the absence of study, the aim of this project is to bring out of oblivion a democratic institution that is fundamental to our understanding of the country's social, political and legal history. Given the exploratory dimension of the project, its ambition is not to propose a ‘total’ history of the Portuguese jury, but to lay the foundations for the development of this field of research. To this end, three key objectives have been defined. The first is to identify the archives available for the investigation on the jury throughout Portugal. The second objective consists of identifying the various issues raised by the study of the jury in its social, political and legal dimensions. The third objective is to examine the place of the Portuguese jury in the context of the expansion of the institution in Europe in the long 19th century. This transnational and comparative perspective of the project shows that the jury is not a historical object frozen in a national past.
Whether at the dawn of the 19th century or today, the issues outlined by this institution question the rights of citizens to participate in representative democracy.
