Abstract
Neste artigo abordam-se os processos de negociação com maior relevância na actividade dos juristas. Recorrendo a resultados da investigação interdisciplinar neste domínio, são analisados e discutidos problemas negociais frequentes no contexto jurídico. Especial atenção é atribuída à construção de soluções negociadas em clima litigioso e às
intervenções de mediação. São igualmente analisados os problemas éticos na negociação, salientando a importância
dos factores contextuais na persistência das falhas éticas mais comuns.
