Abstract
O Direito à Segurança Social é configurado na Constituição da República Portuguesa (CRP), desde 1976, como um Direito Fundamental1 , de caráter universal: “Todos têm direito à segurança social” (artigo 63º nº 1) da CRP), cabendo ao Estado “organizar, coordenar e subsidiar um sistema de segurança social ”(art.º 63.º, n.º 2).
O Direito à Segurança Social insere-se no capítulo respeitante aos “direitos e deveres económicos, sociais e culturais”, também designados peladoutrina tradicional como direitos de segunda geração (por contraposição aos de primeira geração, associados aos direitos civis e políticos, cujas origens remontam a sinais do séc. XVIII), desenvolvidos, sobretudo a partir de meados do século XX.
